Welcome to JenKenStudios.com. These Terms & Conditions govern your use of this website and your purchases, inquiries, service requests, and other interactions with JenKenStudios. By using the website, placing an order, submitting a request, or subscribing to communications, you agree to these Terms & Conditions.

1. Website Use

JenKenStudios.com is operated by Jen Kennedy and is provided to showcase and sell original artwork, fine art prints, and related creative services. You agree to use the website only for lawful purposes and not to interfere with its operation, security, or use by others.

2. Artwork and Products

JenKenStudios offers original artwork, fine art prints, custom print requests, custom framing coordination, and commissioned artwork. Original works may be one-of-a-kind and may include a certificate of authenticity. Fine art reproductions may be offered in multiple sizes or configurations. Product images are intended to represent the artwork as accurately as reasonably possible. Colors may vary depending on screen settings, device displays, lighting, print materials, and production methods. Minor color or appearance differences between a digital image and the physical artwork are not considered defects.

3. Availability and Pricing

All products are subject to availability. Original artwork may be unique and may become unavailable without notice. JenKenStudios may update prices, product descriptions, options, or availability at any time and may correct errors or inaccuracies on the website. Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other fees may be added at checkout or otherwise disclosed before payment.

4. Payment

Payments made through the website are processed using third-party payment services made available through the site. JenKenStudios does not guarantee the availability of any particular payment method. Orders are not complete until payment is successfully authorized or otherwise accepted.

5. Custom Prints, Framing, and Commissioned Artwork

Custom print sizes, custom framing requests, and commissioned artwork are subject to review, availability, pricing, and approval. Submitting an inquiry does not create a binding order. Additional terms, deposits, timelines, revision limits, or other project-specific requirements may be provided before custom work begins. JenKenStudios may collaborate with independent local framing professionals. When framing work is performed by an independent provider, that provider may be responsible for its own services, timelines, and workmanship.

6. Shipping

JenKenStudios currently ships within the United States only. International shipping is not currently offered. Shipping availability may be expanded in the future, and this policy may be updated when additional destinations become available. Shipping costs and available delivery methods may vary based on the item, size, destination, and carrier. Delivery dates are estimates only. JenKenStudios is not responsible for carrier, weather, transportation, or other delays outside its reasonable control.

7. Returns, Refunds, Damaged, Defective, or Incorrect Items

All sales are final except where required by law or where an item arrives damaged, defective, misprinted, or incorrect. If your order arrives damaged, defective, misprinted, or you receive the wrong item, contact JenKenStudios at jenniferarielkennedy@gmail.com within 7 days after delivery. Include photographs of the item, packaging, shipping label, and any visible damage or error. Please keep all original packaging while the claim is being reviewed. After the issue is reviewed and confirmed, JenKenStudios will work with the customer to provide an appropriate replacement or other reasonable resolution. For one-of-a-kind original artwork that cannot be replaced, JenKenStudios will work directly with the customer to determine an appropriate resolution. Custom artwork, commissioned pieces, custom-sized prints, and other personalized products are final sale except where the item arrives damaged, defective, or incorrect, or where applicable law requires otherwise.

8. Intellectual Property

Unless otherwise stated, the artwork, photographs, graphics, designs, text, branding, and other creative content appearing on JenKenStudios.com are owned by or licensed to Jen Kennedy and JenKenStudios and are protected by applicable intellectual property laws. Purchasing an original artwork, print, or other physical product does not transfer copyright, reproduction, licensing, or commercial-use rights. Artwork and website content may not be copied, reproduced, distributed, modified, used to create derivative products, or commercially exploited without prior written permission.

9. Email Communications

Visitors may voluntarily subscribe to receive news, updates, and information about artwork and exclusive prints. You may unsubscribe from marketing emails at any time using the unsubscribe option provided in those messages. Transactional or service-related communications may still be sent when necessary to complete an order or respond to an inquiry.

10. Third-Party Services

The website may rely on third-party services for hosting, payments, analytics, email communications, shipping, and other functionality. Those services are governed by their own terms and privacy practices, and JenKenStudios is not responsible for their independent operation or policies.

11. Website Disclaimer

JenKenStudios makes reasonable efforts to keep website information accurate and current but does not guarantee that all content, pricing, availability, descriptions, or functions will always be complete, current, or error-free. The website is provided on an "as available" basis to the extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, JenKenStudios and Jen Kennedy will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or from products or services purchased through it. Nothing in these Terms limits rights or remedies that cannot legally be excluded.

These Terms & Conditions may be updated from time to time. Changes will be posted on this page with a revised Last Updated date. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
